1. Acceptance and scope
By browsing merzsoft.com you accept these terms as they apply to use of the site. If you disagree, you should stop using it.
The site provides general information about MERZSOFT and a way to start a conversation. It is not an online store and does not by itself create a contractual relationship.
2. Information, quotations, and engagement
- Examples, ranges, timelines, and descriptions on the site are indicative and are not an irrevocable offer.
- A project begins only when the parties agree in writing on scope, deliverables, price, schedule, responsibilities, and acceptance.
- A project-specific proposal or contract prevails if it differs from these general terms.
3. Permitted use
You may read the content and contact MERZSOFT for legitimate purposes. You may not attempt to compromise the site, interfere with operation, send spam, introduce malicious code, impersonate others, scrape content abusively, or use it to violate third-party rights.
4. Intellectual property
The brand, visual identity, copy, designs, code, and published materials belong to MERZSOFT or are used with permission unless stated otherwise. No license is granted to reproduce, sell, or create derivative works beyond uses allowed by law.
Ownership and licenses for client deliverables are defined in the applicable contract, including pre-existing components, third-party software, and client-provided materials.
5. Availability and accuracy
We seek to keep content accurate and the site available, but errors, maintenance, changes, or interruptions may occur. Content may be updated or removed when necessary without affecting obligations already assumed under a contract.
6. Third-party services and links
The site may link to external platforms. MERZSOFT does not control their availability, content, security, or policies. Their own terms govern their use.
7. Liability
To the extent allowed by law, MERZSOFT is not liable for decisions based solely on general site information, third-party failures, or use contrary to these terms. Nothing here excludes liability that cannot legally be limited or obligations expressly assumed by contract.
8. Privacy
Personal data processing and browser storage are explained in the Privacy policy and Cookies and local storage policy.
9. Governing law and disputes
These terms are interpreted under the laws of the Plurinational State of Bolivia. Before starting a formal claim, we will seek to resolve any difference through direct, good-faith communication. If that is not possible, the competent authority will apply according to the nature of the matter.
10. Changes
These terms may be updated to reflect technical, commercial, or legal changes. The current version is the one published with its update date.
These pages describe the general operation of the site. A signed proposal or contract may establish project-specific conditions and will govern that service.
