1. Controller and scope
MERZSOFT is responsible for personal data submitted directly through this site. This policy applies to merzsoft.com, its contact form, and communications that originate from it.
Client services may be subject to additional privacy terms in their proposal, contract, or confidentiality agreement.
2. Data we may process
- Contact form data: full name, email address, company —if you choose to provide it— and message content.
- Information you voluntarily share in a conversation by email, WhatsApp, video call, or another channel you choose.
- Minimum technical data infrastructure providers may process to deliver the site, prevent abuse, and keep security records, such as date, time, IP address, user agent, and network headers.
- Browser preferences described in the Cookies and local storage policy.
We do not ask for passwords, banking information, medical information, or identity documents through the public form. Do not include them in your message.
3. Why we use information
- To answer inquiries and understand the needs of a potential project.
- To prepare meetings, proposals, quotations, and, where applicable, a contractual relationship.
- To confirm receipt of a message and continue the communication requested by you.
- To protect the site, prevent spam, fraud, or abuse, and resolve technical incidents.
- To meet legal, contractual, accounting, or rights-request obligations where applicable.
We do not sell personal data or use it for personalized advertising. We also do not make automated decisions that produce legal effects on individuals.
4. Consent and grounds for processing
Before the form is submitted, we ask you to confirm that you have read this policy and authorize the processing needed to answer your request. You may withdraw consent for future communications without affecting prior processing or information we must keep by law.
If an inquiry becomes a commercial relationship, some processing will also be necessary to prepare or perform the agreement and meet applicable obligations.
5. Providers and recipients
Access is limited to people and providers who need it to operate the site and handle your request. These currently may include:
- Cloudflare for hosting, delivery, security, and aggregated technical site metrics.
- Brevo for transactional delivery of the form and its confirmation.
- Google/Gmail as the email service used to receive and answer inquiries.
- WhatsApp and linked social networks only if you choose to open or communicate through those platforms; their own policies also apply.
- Advisers, authorities, or specialist providers where required by law, to defend rights, or to perform a requested service under confidentiality duties.
Some providers may process data outside Bolivia. We seek to use established services and limit data to what is necessary, while their operations are also governed by their own terms and safeguards.
6. Retention
- Inquiries that do not lead to a contractual relationship are retained for up to 12 months after the last interaction, unless a legitimate obligation or dispute requires longer retention.
- Client and project information is retained during the relationship and for any later period required by contractual, accounting, tax, or legal obligations.
- Technical logs and backups may remain for each provider’s limited retention cycle before deletion or overwrite.
We may anonymize information for internal statistics; once irreversibly anonymized, it no longer identifies an individual.
7. Your rights
You may request access, updating, correction, or deletion; object to a use; withdraw consent; and ask about recipients, within the limits of applicable law.
We will respond within a reasonable period. Information may be retained where required by legal, contractual, security, or claims-defense obligations.
8. Security and confidentiality
We use reasonable technical and organizational measures to reduce unauthorized access, loss, alteration, or disclosure. No Internet-connected system is completely infallible, so safeguards are reviewed and improved according to the risk and service.
9. Site assistant and browser storage
The assistant conversation is stored temporarily in your browser session to preserve context. In the current version it is not sent to MERZSOFT or an external model unless you choose to transfer information to the form, email, WhatsApp, or another channel.
10. Minors
The site and services are intended for people able to enter into agreements or acting with authorization from their representative. If we identify information improperly submitted by a minor, we may delete it.
11. Policy changes
This page will be updated when the site, providers, or applicable duties change. The date at the top identifies the current version. If a change materially affects previously collected data, we will provide notice through a reasonable channel when needed.
These pages describe the general operation of the site. A signed proposal or contract may establish project-specific conditions and will govern that service.
